Liability Waiver
Hands-on CPR training carries physical risk. Please read this waiver in full before registering.

Activity description
You are voluntarily participating in a hands-on CPR, AED, and First Aid training course operated by 2nd Breath CPR. The course involves physical practice on training manikins and AED trainer devices, includes a written knowledge check and a final skills evaluation, and is taught by AHA-certified instructors.
This is a real, physical class. Knowing what to expect, and disclosing anything that may affect your ability to participate safely, is the purpose of this waiver.
Acknowledgment of risks
Hands-on CPR training is physically demanding. By participating, you acknowledge and assume the following risks, which are not exhaustive:
- Musculoskeletal strain of chest, back, shoulders, wrists, and knees from sustained chest compressions and floor-level practice
- Cardiovascular exertion from repeated compressions and rescue breathing. Students with cardiac history, hypertension, or a recent cardiac procedure should consult their physician before participating
- Risks associated with pregnancy, particularly in the third trimester
- Exacerbation of pre-existing injuries: recent surgery (especially chest, shoulder, wrist, back), joint injury, or limited mobility may worsen during the practice
- Slips, trips, and falls during recovery-position practice and choking demonstrations
- Latex allergy from training gloves (non-latex alternatives are available upon request)
- Contact with shared training equipment despite our cleaning protocols and provision of single-use barrier devices per student
- Bloodborne pathogen exposure in the event of cuts or open wounds during bandaging or splinting drills (low risk)
- Communicable illness transmission from close-proximity instruction
- Psychological discomfort discussing cardiac arrest, death scenarios, or traumatic emergency situations
You confirm that, to the best of your knowledge, you are in suitable physical condition to participate in this activity. If you have any condition that may affect your ability to safely participate, you will either disclose it to your instructor before the class begins or consult with your physician beforehand.
Release of liability
To the fullest extent permitted by Florida law, you release, waive, discharge, and covenant not to sue 2nd Breath CPR, its owners, instructors, employees, contractors, and the venue hosting the class (collectively, the "Released Parties") from any and all claims, demands, or causes of action arising out of or related to ordinary negligence in connection with your participation in this class, including any injury, illness, property damage, or other loss you may suffer.
This release does not apply to liability arising from gross negligence, intentional misconduct, or any other conduct that cannot be waived under Florida law.
Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from any claim or demand brought by a third party (including your family members) arising out of your conduct or actions during the class, to the fullest extent permitted by Florida law.
Conduct and rules agreement (required)
This is a separate, required consent collected on our schedule form alongside the liability waiver. By agreeing, you commit to:
- Follow all park rules, venue rules, and applicable laws during the class
- Conduct yourself respectfully toward the instructor, fellow students, and members of the public
- Comply with instructor guidance on safety, equipment use, and class structure
We reserve the right to ask any student to leave a class for disruptive, aggressive, harassing, or unlawful conduct, with the assistance of venue staff or law enforcement where appropriate. Civil or legal action may be pursued where warranted, including for damage to property, threats, or harassment directed at staff or other attendees.
The class fee is non-refundable when a student is removed for cause under this section. Our standard refund policy (full refund 3+ weeks out, 50% within 2–3 weeks, no refund inside 2 weeks) does not apply to conduct-based removals.
Photo, video, and audio recording (optional)
We frequently record our classes, primarily to capture the instructor for quality-assurance review and to build follow-up training videos that students can re-watch with any questions. Group participation may incidentally appear on camera.
On the schedule form, there is a separate, optional checkbox for recording consent.
- If you check it: 2nd Breath CPR may capture your image, voice, or likeness during class and use that material for instructor quality-assurance review, internal training improvement, and follow-up educational videos. Marketing use of recognizable footage requires your separate written opt-in, requested at the time the footage is selected.
- If you leave it unchecked: we will position the camera and conduct the class so that you do not appear in any recording. Tell your instructor again at class start as a reminder. We'd rather over-confirm than catch you on camera by mistake.
- You may revoke consent at any time before or during class by telling your instructor, or afterward by emailing info@2ndBreathCPR.com. We will remove or blur identifiable footage of you on our next editing pass.
We do not sell student footage to third parties. We do not share it outside of our own quality- assurance, training-development, and (with separate marketing opt-in) marketing channels.
Severability
If any provision of this waiver is found unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
Governing law
This waiver is governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Hillsborough or Pinellas County, Florida.
Florida Good Samaritan Act (informational)
Florida Statute §768.13 (the Good Samaritan Act) provides civil-liability protection to volunteers rendering emergency care in good faith. This protection applies to bystanders performing CPR or First Aid in real emergencies. It is mentioned here for educational context and does not affect the terms of this waiver.
Voluntary acknowledgment
You are accepting this waiver voluntarily. You have had the opportunity to read its contents in full, ask questions, and decline participation if you choose. By submitting our schedule form with the waiver acknowledgment checkbox marked, you confirm:
- You have read this waiver in full
- You understand its terms
- You agree to be bound by it upon class attendance
- You are signing for yourself, or, if the participant is a minor, on behalf of the minor as parent or guardian
For minors (participants under 18)
If the participant is under 18 years of age, the parent or guardian acknowledging this waiver:
- Represents that they have legal authority to consent on the minor's behalf
- Assumes the same risks on the minor's behalf as enumerated in this waiver
- Provides emergency contact information for use during the class
- Acknowledges that the minor may be required to demonstrate skills physically as part of the evaluation
- Confirms that they will accompany the minor to class or have arranged with us in writing for the minor to attend unaccompanied
